These Terms and Conditions are applicable every time you access our website and/or order goods from our website.

Before proceeding with an order you will be required to show that you have read and understood the following terms and conditions. We recommend that you print a copy of these Terms and Conditions for your future reference.

1. Ownership

1.1 All rights in this website are owned by us. Any unauthorised use, copying or modification is prohibited.

2. Ordering Goods

2.1 You may only purchase Products from us if: 

a) you are legally capable of entering into a binding contract with us (for example, in England and Wales you must be at least 18 years old); 

b) you are an authorised user of the credit or debit card used to pay for your order; and,

c) are resident in a country that we deliver to.

2.2 All orders placed through our website will be subject to our acceptance of the order.

2.3. We will not process your order until payment has been received in full. If we accept your order a ("Contract") will be formed.

2.4 Should you wish to cancel your order or return any goods, please go to the returns section for further information.

2.5 Please note, you are responsible for all purchases made on your account and are personally liable for all the outstanding balance.

2.6. These terms and conditions, and any Contract between us, are only in the English language. Please note that We may not necessarily keep a copy of your Contract. You should keep a copy of these terms and conditions and your order for future reference.

3. Processing your orders and payment

3.1 The price payable for the Products shall be as shown on our site in pounds sterling (GBP). Prices advertised on our site include UK VAT at the relevant rate chargeable for the time being, but exclude delivery charges which are payable in addition and shown separately during the checkout process. 

3.2 We can change the prices on our site at any time without notice, but changes will not affect orders, which We have already accepted.

3.3 We accept payment by debit card, credit card or Paypal.

3.4 Whilst it is our intention to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.

3.5 All prices shown on our website are inclusive of VAT. For further information on delivery charges see the Delivery section.

4. Delivery

4.1. Delivery of your order will be complete when. We deliver the Products to the address you gave us and the Products will be your responsibility from that time. 

4.2 Whilst we make every effort to deliver goods on the day we specify, we cannot guarantee delivery on that day or accept liability for deliveries made outside this timescale. This also applies to products sent direct from our manufacturers. We cannot accept liability for out of pocket expenses or other costs incurred due to failed or delayed deliveries.

4.3 If no one is available at your address to take delivery and the Products cannot be posted through your letterbox or left in a safe place, after three failed attempts, we may end the Contract, and issue a refund.

4.4 You will own the Products once. We have received payment in full.

4.5 The images of the Products on our site and in our other advertising materials are for illustrative purposes only. Your Products may vary slightly from those images. Although We have made every effort to display and print the colours of the Products accurately, We cannot guarantee that your computer's display of the pictures, or the pictures in our other advertising materials, accurately reflect the colours of the Products that will be delivered to you.

4.6 All items are subject to stock availability.

4.7 Please note that if you wish to return goods under our Approval guarantee, you have 14 days from receipt of the goods to return them to us.

4.8 If an item is faulty please contact us and we will arrange an appropriate remedy.

4.9 We reserve the right to stop a delivery at any time, including after despatch, if we suspect that the transaction might be fraudulent.

5. Your right to cancel the contract

5.1 If you are a consumer in the European Economic Area (“EEA”), you have a legal right to cancel a Contract if you change your mind until 14 days after you receive (or someone you nominate receives) the Products, unless the Products are split into several deliveries over different days in which case you will have until 14 days after the day you receive (or someone you nominate receives) the last delivery.

6. Our rights to cancel the contract

6.1 We may end the Contract at any time by writing to you if: 

a) you do not make any payment to us when it is due;

b) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Products; or 

c) you do not, within a reasonable time, allow us to deliver the Products to you.

6.2 We will refund any money you have paid in advance for the Products. We have not provided but We may deduct or charge you reasonable compensation for the costs. We will incur as a result of your breaking the Contract.

7. Faulty products

7.1 If you are a consumer, We are under a legal duty to supply Products that are in conformity with the Contract. Nothing in these terms and conditions will affect your legal rights in relation to Products that are faulty or defective. 

7.2 If you consider that any Product We have supplied is faulty or mis-described. You must return such Products to us in accordance with our reasonable instructions and the returns Policy, and if the Products are faulty or mis-described We will refund the price of the Products and the cost of delivery to you.

8. Our liability

8.1 If We fail to comply with these terms and conditions. We shall not be responsible to you whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non performance of our obligations under these terms and conditions including such damage as may be reasonably foreseeable at the date you order the goods.

8.2 We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any matter for which. We may not exclude or limit our liability under any applicable law. 

8.3 Our liability for any claim for loss or damage shall be limited to the sum paid by you for the goods.

8.4 A person who is not a party to these terms and conditions shall have no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

8.5 You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with our specific permission in writing.

8.6 We reserve the right to change these terms and conditions from time to time and any such changes will be communicated on our website.

8.7 These terms and conditions govern the entire trading relationship between you, and us and will remain in force for the duration of our trading relationship.

9. Privacy Policy

9.1 Please make sure that you have read and understood our Privacy Policy that explains how we safeguard any data which you provide to us in order for us to fulfil your online order.

10. Copyright

10.1 We grant you a limited, non-exclusive and revocable licence to access our website for the purposes of browsing our product(s) , ordering goods or services from us, or obtaining contact information for us.

10.1 All intellectual property rights (including use of trade marks) shall be solely owned by us. You are permitted only to use material on this website as expressly authorised by us.

11. Other important terms

11.1 Nothing in these terms and conditions shall affect your rights as a consumer under the applicable law in the jurisdiction in which you are resident. 

11.2 If We have to contact you, We will do so by in writing or telephone, using the contact details you provided to us in your order, unless you have asked us to contact you by any other means. When We refer in these terms and conditions to “in writing”, this includes e-mail. 

11.3 We may change these terms and conditions from time to time. The terms and conditions that apply to your Contract will be those that are displayed on our site when you place your order. 

11.4 We may transfer our rights and obligations under the Contract to another organisation. We will tell you in writing if this happens and We will ensure that the transfer will not affect your rights under the Contract. 

11.5 You may only transfer your rights or your obligations under these Terms to another person if We agree in writing.

11.6 The Contract is between you and us. No other person shall have any rights to enforce any of its terms.

11.7 Please note that these terms and conditions are governed by English law. If you are a consumer, this means a Contract for the purchase of Products and any dispute or claim arising out of or in connection with it will be governed by English law, except that if you are not resident in England then English law shall apply only to the extent that it does not override any mandatory laws of the country in which you have your usual place of residence.

11.8 In respect of any dispute or claim relating to a Contract, if you are a consumer you and We both submit to the non-exclusive jurisdiction of the courts of England and Wales, but nothing in this clause shall limit your legal rights to bring actions against us or to require proceedings to take place in the country in which you have your usual place of residence. If you are not a consumer, you and We both submit to the exclusive jurisdiction of the courts of England and Wales. 

12. Returns policy

12.1 Every purchase is given at least 14 calendar days to return something. 

12.2 You must return an item in the same condition as it was received, not altered in any way, as well as including:

·       All original packaging such as boxes, bags and tags

·       All items included in a bundle

 

1.      Re-pack your item(s) in the original packaging, or in a secure, waterproof package with labels and tags still attached.

2.      Clearly attach the returns label to the parcel.

3.      Return your package via the Post Office, remembering to get proof of postage. Please don’t post your package through the post box without getting proof of postage. Keep it safe in case you need to use this as evidence of your return.

12.3 If you receive faulty goods, you may also have a right to return these goods and to ask us to repair or replace them or get a refund.

12.4 Refunds will not be given if they do not comply with our returns policy.

13. Changes to these Terms of Use

We may revise these Terms of Use at any time by amending this page. Every time you wish to use our site, please check these Terms of Use to ensure you understand the terms that apply at that time.
